ICE Issues New Procedures for Asylum Seekers Seeking Release From Detention
On December 16, 2009, ICE announced plans to release arriving aliens who have a credible fear of persecution or torture and are currently detained. The new policy will go into effect January 4, 2010. A Fact Sheet follows the News Release. AILA Doc. No. 09121761.

ICE Statement on the President’s FY 2009 Budget Request

On 02/28/08, ICE Assistant Secretary Julie Myers testified before the House Appropriations Committee Subcommittee on Homeland Security on the President’s FY 09 budget request for ICE. ICE Announces 1,000 New Workplace Audits

On 11/19/09, ICE Assistant Secretary John Morton announced the issuance of Notices of Inspection (NOIs) to 1,000 employers associated with critical infrastructure, alerting business owners that ICE will audit their hiring records to determine compliance with employment eligibility verification laws. DHS Announcement on First Year of Secure Communities Initiative and Expansion

On 11/12/09, DHS Secretary Janet Napolitano and ICE Assistant Secretary John Morton announced that ICE's Secure Communities initiative will have a presence in every state by 2011 and be available to every US law enforcement agency by 2013. O’Hare Airport Temporary Staffing Employees Sentenced for Harboring Undocumented Aliens

On 9/30/09 ICE announced that the owner of a Bensenville, IL temporary employment agency and her assistant were sentenced in federal court for harboring undocumented aliens and assisting those workers in obtaining unauthorized access to secure areas at O'Hare International Airport, including the tarmac. Fort Worth Woman Sentenced to 44 Months for Visa Fraud Scheme

On 9/23/09 ICE announced that Maria Refugia Camarillo was sentenced to 44 months in federal prison following her guilty plea for conspiring to commit fraud in connection with immigration documents. Between 1980 and 2008 foreign nationals, who wanted to become U.S. permanent residents, paid Camarillo to arrange a marriage between them and a U.S. citizen. AILA Doc. No. 09092561.

Florida Man Convicted At Trial For Selling Fraudulent Indian Documents

On 9/22/09 ICE announced that Audie Watson of Tamarac, FL was found guiltyfor fraud, immigration, and money laundering crimes. Watson sold membership in a Native American tribe called the Pembina Nation Little Shell to undocumented aliens in order for them to make claims of Native American lineage to immigration authorities and thereby avoid removal. Immigration Consultant Sentenced to 41 Months in Prison for Fraud

Shahrzad Eram Soleimanlou, 59, of Falls Church, Va., was sentenced to 41 months in prison for defrauding vulnerable immigrant applicants of approximately $1 million from June 2000 through December 2005. ICE’s Miami Field Office Removes 423 Criminal Aliens in August

Four hundred twenty-three criminal aliens from 36 different countries were removed last month by deportation officers from the Ice Miami Field Office of Detention and Removal. The individuals who were removed had a variety of criminal convictions including assault, burglary, drugs, fraudulent activities, larceny, robbery, sexual assault and weapons offenses. AILA Doc. Miami Residents Sentenced for Conspiracy to Defraud Undocumented Individuals in Florida and New York

On 9/21/09 ICE announced that three Miami residents were sentenced on charges of conspiracy to commit wire fraud, wire fraud and making false statements in immigration papers. Missouri Poultry Processing Plant Pays $450,000 Fine for Hiring Undocumented Workers

A May 2007 enforcement by ICE agents found 136 undocumented workers at George's Processing Plant in Springfield, MO. Twenty-eight workers were criminally prosecuted for various immigration violations, including falsely claiming U.S. citizenship. Two of the company's hiring personnel were convicted of harboring illegal aliens and inducing illegal aliens to remain in the U.S. AILA Doc. No. 09091660.

Houston Immigration Attorney Sentenced For Visa Fraud And Money Laundering

ICE announced that Kenneth Rothey, a Houston immigration attorney was convicted and sentenced on 8/18/09 for money laundering and conspiring to engage in visa fraud. Rothey and members of his firm prepared and presented fraudulent petitions and supporting documents on behalf of their clients to the former Immigration and Naturalization Service. AILA Doc. Bay Area Sham Marriage Broker Sentenced to 19 Months in Prison

ICE Identifies Additional Detention Deaths

Shipley Do-Nuts Ordered to Pay Criminal Fine and Forfeit More Than a Million to ICE

On 8/7/09 Shipley Do-Nut Flour and Supply Company Inc. was sentenced to be under court supervision for a period of three years, pay a criminal fine of $250,000 and forfeit $1.334 million to ICE for harboring illegal aliens. ICE Announces Immigration Detention Reforms

Krispy Kreme Fined Following I-9 Audit

On 7/7/09 ICE announced a $40,000 settlement had been reached with Krispy Kreme Doughnut Corporation. An I-9 audit revealed the company employed unauthorized workers in a Cincinnati, Ohio factory. Chinese Buffet Restaurant Owner Sentenced and Fined for Hiring Undocumented Workers

On 1/15/09 ICE announced that it has notified the Central Falls Detention Facility Corporation of the agency's intention to terminate the agreement to house detainees at the Donald Wyatt Detention Facility in Rhode Island. Restaurant Owner Sentenced to Eight Months for Knowingly Employing Undocumented Workers
