Idaho Passes Restrictive Driver License Law

Cite as "AILA InfoNet Doc. No. 08061768 (posted Mar. 5, 2008)"

On 03/05/08, Idaho Governor C.L. "Butch" Otter signed HB 366 into law. The law prohibits driver’s licenses from being issued to persons not lawfully present in the US. For non-citizens or permanent legal residents, the law requires the expiration date of the license to be the same date as the end of lawful stay. Those whose documents do not state an expiration date will be issued a driver’s license valid for one year.

Opponents of the bill pointed out that the bill creates even more traps for people who are in the US under variety of visa programs or are waiting word on asylum applications, and will create an additional burden for employers and local law enforcement.
