USCIS Instructs on Postings for Schedule A Applications
USCIS advises AILA's liaison of instructions to the field on how to handle Schedule A I-140s in which evidence of fulfillment of the posting/union notification requirement was omitted.

SCOPS Reverses Response on Timing of Filing of 7th Year H-1B
Service Center Operations reverses its previous answer, and indicates that an H-1B extension beyond the 6th year will be subject to denial if is filed before the 365 days have run since filing of the labor certification application.

USCIS Discusses Timing of Filings As the Fee Changes And Other Issues (4/26/04)
The AILA/Service Center Operations teleconference on 4/26/04 included discussions of how USCIS will deal with fees on filings around the April 30 changeover in filing fees, where to file an E derivative I-539, concurrent filing, and H-1B cap issues. These minutes have been approved by USCIS.

USCIS Reports Relatively Low Volume of H-1B Filings
The Service Center Operations (SCOPS) unit of USCIS has indicated to AILA that it has NOT seen the expected spike in H-1B filings since April 1, when employers were again permitted to file cap-subject petitions with start dates beginning October 1 or later.

I-129W: The Key to H-1B Non-Cap Cases
Service centers are indicating that they are using the I-129W to determine whether a case is subject to the H-1B cap, so careful completion of that form is important. If a case not subject to the cap was rejected for cap reasons, please contact the appropriate AILA service center liaison.

Recent Delays in Advance Parole Issuance
USCIS has advised AILA's Service Center Operations liaison that the Service Centers have been unable to process routine advance parole requests because they lacked sufficient quantities of the security paper on which the documents are printed. Interim paper stock has now arrived.
