DOJ Publishes Final Rule on US-Canada Agreement on Asylum Claims Made in Transit and at Land Ports of Entry

Effective 12/29/04, the final rule adopts without substantial change the proposed rule implementing the 12/5/02 US-Canada agreement on asylum and refugee applicants barring certain aliens arriving from Canada, or in transit during removal from Canada, from applying for asylum and related protections in the US. DOJ Publishes Final Rule on 212(c) Relief

Effective 10/28/04, the final rule provides procedures and deadlines for filing motions for 212(c) relief before an IJ or the BIA for eligible aliens in proceedings or under final deportation/removal orders. The rule addresses certain criminal convictions resulting from pre-4/1/97 plea agreements reached prior to trial verdict. (69 FR 57826, 9/28/04).

EOIR Publishes Interim Rule Amending Regulations to Use References Rather than Duplicate Provisions and to Make a Technical Correction
