  • DOS Rule on NATO Immigrant Classification (12/11/1998)
    This final rule amends the DOS's regulations to comply with new statutory authority. The rule extends fourth preference special immigrant classification to civilian employees of the North Atlantic Treaty Organization (NATO) provided they meet certain qualifying criteria.
  • Final Rule on Visas: Grounds of Ineligibility (11/24/1998)
    This rule finalizes the interim rule published 12/29/97 (62 FR 67564) and implements sections of IIRAIRA for: aliens not inoculated against infectious diseases; aliens subject to civil penalties; alien student visa abusers; aliens present in U.S. w/o admission/parole; aliens fail to attend removal proceedings; unlawful alien voters.
  • Nigeria; Determination Under Presidential Proclamation (11/18/1998)
    The suspension of entry into the United States as immigrants and nonimmigrants of persons who formulate, implement or benefit from policies that impede Nigeria's transition to democracy is no longer necessary.
  • Libya Passport Restrictions (11/18/1998)
    All United States passports are declared invalid for travel to, in, or through Libya unless specifically validated for such travel. This restriction has been renewed yearly because of the unsettled relations between the United States and the Government of Libya and the possibility of hostile acts against Americans in Libya.
  • Extension of Passport Validity (11/9/1998)
    DOS, Bureau of Consular Affairs, announcement of passport validity for selected countries. Slovenia and Taiwan have now been added to this list.
  • Foreign Passports Validity (10/9/1998)
    This Public Notice updates the list of countries that have concluded agreements with the Government of the United States. By so agreeing the country in question effectively extends the validity period of the foreign passport an additional six months notwithstanding the expiration date indicated in the passport.
  • DOS Final Rule on NIV Applications and Fees (10/2/1998)
    DOS final rule, with one amendment, adopting the interim rule published at 63 FR 24107, 5/1/98, relating to the waiver of visa fees for a nonimmigrant alien who will be engaged in charitable activities in the U.S. (63 FR 52969, 10/2/98) AILA Doc. No. 98100260.
  • Documentation of Nonimmigrants and Immigrants (9/11/1998)
    This rule combines several minor corrections or updating of current nonimmigrant visa regulations with the deletion of several immigrant visa regulations that are inoperative as a result of the repeal or expiration of the underlying provisions of law.
  • Exchange Visitor Policy (8/7/1998)
    The USIA announces its policy regarding requests for waiver of the two-year home country physical presence requirement set forth in Section 1182(e) of the Immigration and Nationality Act based upon the applicant's assertion that fulfillment of such requirement is not possible due to the loss of home country citizenship.
  • Overstay Rule Correction (7/6/1998)
    This DOS document confirms as a final rule the interim rule published on January 7, 1998, that establishes the venue for a nonimmigrant visa application by an applicant whose previous nonimmigrant visa has been voided due to an overstay of an authorized period of admission. This notice also contains a correction of a citation in the interim rule.
  • Exchange Fee Visitor Rule (6/26/1998)
    The USIA adopts a fee sufficient for it to recover the full cost of its administrative processing of requests for waiver of the two-year return to the home country requirement set forth in Section 212(e) of the INA. This interim rule is effective June 26, 1998.
  • DOS on Nonimmigrant Fee Waiver (5/1/1998)
    This interim DOS rule results from a recent amendment to the law. It permits the Secretary of State to waive the visa fees for a nonimmigrant alien who will be engaged in charitable activities in the United States.

  • DOS Interim Rule on Border Crossing ID Cards (4/7/1998)
    The rule provides authority for DOS consular officers to issue to Mexican citizens who are residents of Mexico a combined B-1/B-2 visa and border crossing card (B-1/B-2 Visa/BCC) as a stand-alone card containing a machine-readable biometric identifier. Canadian BCCs are also discussed.
  • DOS Rule on 212(o) (4/6/1998)
    DOS is removing the regulation that implemented section 212(o) of the INA. Congress allowed INA 212(o) to sunset as of September 30, 1997.
  • DOS on Refused NIVs (3/17/1998)
    DOS Porposed Rule that formalizes the non-acceptance-for-six-months policy with respect to a new application from an alien whose prior NIV application has been refused under the provisions of INA 214(b).
  • NAFTA Final Rule on Investors/Traders (3/3/1998)
    This rule finalizes the interim regulations published 12/28/93 concerning two nonimmigrant business visa classifications, treaty traders and investors and intracompany transferees, and promulgates new regulations for a category for professionals under INA section 214(e), as amended by the Implementation Act.

  • DOS Interim Rule on Nonimmigrants (1/7/1998)
    DOS Interim Rule on nonimmigrant visas. This rule outlines the procedures for the issuance of new nonimmigrant visas in the applicant's native country for instances when a person has overstayed in the United States. Waivers for 'extraordinary circumstances' are also discussed.
