  • EOIR Proposes Attorney Registration Program (12/30/2003)
    EOIR proposes a rule to authorize itself to require registration of attorneys and representatives as a condition of practicing before IJs and the BIA. The preamble indicates that the proposed rule is to facilitate the institution of electronic filing. (68 FR 75160, 12/30/03)
  • Department of Justice Publishes its Semi-Annual Regulatory Agenda (12/23/2003)
    The Department of Justice published its semi-annual regulatory agenda in the December 22 issue of the Federal Register. The agenda outlines current and projected rulemaking efforts by the Department and provides an estimated timetable for each item. Included is a regulatory agenda for the EOIR.   • EOIR Corrects Class Action Judgment Notice in Barahona-Gomez v. Ashcroft (4/15/2003)
    Correction to EOIR notice advising of the settlement in Barahona-Gomez v. Ashcroft, which challenged prohibitions on granting suspension of deportation after 2/13/97 because of the agency interpretation of the 4,000 cap. (68 FR 18332, 4/15/03).
  • DOJ Exempts FBI’s National Crime Database from Privacy Act’s Accuracy Requirements (3/26/2003)
    A DOJ final rule exempts the FBI’s National Crime Information Center database from the Privacy Act, meaning that the FBI need no longer ensure the accuracy and timeliness of incriminating information about a particular individual before loading it into the nation’s most comprehensive law enforcement database. (68 FR 14140, 3/24/03)
  • INS/DOJ Paperwork Reduction Act Analysis for NSEERS Program (3/26/2003)
    The INS/DOJ estimates, under the Paperwork Reduction Act, that the amount of time spent "per response" for NSEERS Special Registration is 30 minutes.
  • EOIR Issues Notice of Class Action Judgment in Barahona-Gomez v. Ashcroft (3/20/2003)
    EOIR notice advising of the settlement in Barahona-Gomez v. Ashcroft, the class action lawsuit that challenged directives that prohibited the BIA and IJs from granting suspension of deportation after 2/13/97 because of their interpretation of the 4,000 cap. (68 FR 13727, 3/20/03)
  • DOJ Continues Reorganization of 8 CFR, Conforming Internal Citations (3/5/2003)
    The DOJ has issued a final rule effecting technical amendments to internal citations in new 8 CFR Chapter V (8 CFR was reorganized in a 2/28/03 rule to reflect the transfer of INS to Department of Homeland Security and the retention of EOIR within DOJ). (68 FR 10349, 3/5/03)
  • OSC Announces Availability of Public Education Grants (3/5/2003)
    The Office of Special Counsel for Immigration Related Unfair Employment Practices (OSC) announced the availability of grant funds to conduct public education programs about immigration related employment discrimination. (68 FR 10487, 3/5/03)
  • DOJ/INS Withdraws B Regulation (3/4/2003)
    The rule finalizing the controversial regulation proposed on April 12, 2002, relating to the admission of individuals under B status, has been withdrawn from OMB, where it was being processed for publication. It is unknown whether the rule will be revived by DHS.
  • DOJ Implements Flight Training Candidate Checks Program (2/28/2003)
    Final rule, effective March 17, implementing provisions of Aviation and Transportation Security Act, which imposes notification and reporting requirements on certain persons who provide aviation training to aliens and other specified individuals. (68 FR 7313, 2/13/03)
  • DOJ Reorganizes 8 CFR, Reflecting Demise of INS (2/28/2003)
    Final DOJ rule reflecting transfer of INS to Department of Homeland Security (and retention of EOIR within DOJ), including creation of new 8 CFR Chapter V. (68 FR 9824, 2/28/03).
  • DOJ Terminates TPS Designation for Angola (1/27/2003)
    The DOJ has decided to terminate the temporary protected status (TPS) designation of Angola, effective 3/29/03, based upon a recent review of conditions within that country. Former TPS beneficiaries will maintain the same status they held prior to TPS unless that status has since expired or been terminated.
