  • DOL Alert: iCERT LCA Problems - DOL Aware and Working to Fix (Updated 8:30pm) (4/10/2014)
    DOL is working to fix the “denial warning” issue that members have reported receiving relating to Step 5, when attempting to submit LCAs on iCERT. In the meantime, DOL reports that the error message is “false,” and should not result in the LCA being denied.

  • DOL Atlanta National Processing Center Closed (1/30/2014)
    The AILA DOL Liaison Committee has been informed that the Atlanta National Processing Center was closed yesterday and remains closed today due to the aftermath of this week’s winter storm in the southeast U.S. AILA is awaiting further guidance from DOL as to how filing deadlines will be impacted.

  • Practice Alert: Timing of H-2B Prevailing Wage Determinations and Recruitment(473 KB - 1/24/2014)
    DOL Liaison Committee Practice Alert clarifying that in light of recent changes to the prevailing wage rules for H-2Bs, employers are permitted to commence recruitment before the PWD is issued by DOL, but may need to re-recruit if the OES wage issued is higher than the wage used in recruitment.

    AILA minutes from the 12/12/13 meeting with DOL. DOL confirmed that it is no longer denying cases where the job requires an “engineering” degree without more for computer/tech positions, and that if a license is required, box K.9 can be used to indicate that the beneficiary has the license.
