A 10/10/03 OCIJ memo advises IJ’s to limit off-record discussions to rare occasions, and instructs on clarifying for the record when the recorder is turned off, summarizing the off-record discussion when the recorder is turned on, and asking the parties if there is anything to add to the summary.
