The INS has issued a statement regarding implementation of an audit with respect to its purported 'overage' of H-1B issuances in fiscal 1999. The statement indicates that INS will not release data on the H-1B program until INS is certain of its accuracy, but gives no estimate as to when that certainty might occur.

INS announced Friday that it will stop accepting H-1B visa petitions for FY99 employment of H-1B workers. The INS has determined that the 115,000 annual cap on the H-1B visa category for FY 1999 will be reached on June 15, 1999, based on petitions already filed.

The INS tracks the number of H-1B petitions approved in a fiscal year through CLAIMS after they are adjudicated at the service centers. Each center has its own LAN which captures the information from the Form I-129 which then are downloaded into the mainframe CLAIMS computer on a daily basis. An overall report is then run.
