USCIS Announces 18-Month Extension of Temporary Protected Status for Sudan

On 12/30/09, USCIS announced that the DHS will extend Temporary Protected Status (TPS) for nationals of Sudan from the current expiration of May 2, 2010 to the new expiration date of Nov. 2, 2011. A list of questions and answers follows this update. AILA Doc. No. 09123170.
USCIS Reaches FY 2010 H-1B Cap

On 12/22/09, USCIS announced that it has received a sufficient number of H-1B petitions to reach the statutory cap for FY 2010. USCIS is hereby notifying the public that 12/21/09 is the “final receipt date” for new H-1B specialty occupation petitions requesting an employment start date in FY 2010. AILA Doc. No. 09231221.
USCIS Announces U Nonimmigrant Interim Relief Final Filing Date Extended

On 12/18/09, USCIS announced that it is extending the filing deadline for the expiration of the U Nonimmigrant Interim Relief Program. Individuals are now encouraged to file Form I-918, Petition for U Nonimmigrant Status, by 2/1/10. Classification for Nurses Working in a Health Professional Shortage Area Set to Expire

USCIS reminded the public that the H-1C nonimmigrant category expires on 12/21/09. The H-1C nonimmigrant temporary worker classification authorizes the admission of up to 500 nurses annually to work in eligible health care facilities. The program was created to allow certain crime victims to receive temporary benefits until the regulations governing U visas were published. USCIS Launches Immigration Inquiry Mailbox for Canadian Customers

On 12/9/09, USCIS announced the creation of a general inquiry mailbox for customers in Canada at USCIS.Canada@dhs.gov in addition to obtaining immigration information on the USCIS webpage. USCIS Issues Q & A on Temporary Acceptance of H-1B Petition Filed without DOL's Certified LCAs

USCIS Will Exercise Parole Authority for Certain Foreign Nationals in the Northern Mariana Islands

Court Grants Injunction of Transitional Worker Rule

On 12/2/09, USCIS advised that the U.S. District Court for D.C. granted a preliminary injunction prohibiting implementation of the Transitional Worker Classification interim final rule. USCIS Advises Use of P.O. Box for Mail Delivery in the CNMI

On 12/8/09, USCIS advised anyone who lives in the Commonwealth of the Northern Mariana Islands (CNMI) who is submitting an immigration application to list their Post Office Box where the immigration form asks for a street or physical address. Action to Change USCIS Adjudication of Form I-693, Report of Medical Examination and Vaccination Record

CDC informed USCIS that the availability of the seasonal influenza (flu) vaccine varies both geographically and temporally. Based on CDC's information, Form I-693 may be accepted without the seasonal flu vaccine if the conditions specified in this update are met. CBP Launches Communications Campaign for Travelers Returning from Vancouver 2010 Olympic Winter Games

On 12/01/09, CBP launched a campaign reminding travelers that they will need approved travel documents to enter the U.S. when returning from the Vancouver 2010 Olympic Winter Games. USCIS to Hold Certain Cases Pending Changes to Vaccination Requirements

Law Extends USCIS Programs through September 2012

USCIS Issues Public Charge Fact Sheet

An individual who is likely at any time to become a “public charge” is inadmissible to the U.S. and ineligible to become a legal permanent resident. USCIS Naturalization Test to Become Fully Implemented

USCIS is reminding the public that beginning 10/1/09, all citizenship applicants must take the new naturalization test, regardless of when they filed their Application for Naturalization (Form N-400).
