EOIR proposes a rule to authorize itself to require registration of attorneys and representatives as a condition of practicing before IJs and the BIA. The preamble indicates that the proposed rule is to facilitate the institution of electronic filing. (68 FR 75160, 12/30/03)

Department of Justice Publishes its Semi-Annual Regulatory Agenda

The Department of Justice published its semi-annual regulatory agenda in the December 22 issue of the Federal Register. The agenda outlines current and projected rulemaking efforts by the Department and provides an estimated timetable for each item. Included is a regulatory agenda for the EOIR. DOJ Exempts FBI’s National Crime Database from Privacy Act’s Accuracy Requirements

A DOJ final rule exempts the FBI’s National Crime Information Center database from the Privacy Act, meaning that the FBI need no longer ensure the accuracy and timeliness of incriminating information about a particular individual before loading it into the nation’s most comprehensive law enforcement database. DOJ Continues Reorganization of 8 CFR, Conforming Internal Citations

The DOJ has issued a final rule effecting technical amendments to internal citations in new 8 CFR Chapter V (8 CFR was reorganized in a 2/28/03 rule to reflect the transfer of INS to Department of Homeland Security and the retention of EOIR within DOJ). (68 FR 10349, 3/5/03)

DOJ/INS Withdraws B Regulation

The rule finalizing the controversial regulation proposed on April 12, 2002, relating to the admission of individuals under B status, has been withdrawn from OMB, where it was being processed for publication. It is unknown whether the rule will be revived by DHS.

DOJ Implements Flight Training Candidate Checks Program

DOJ Terminates TPS Designation for Angola
(1/27/2003)
The DOJ has decided to terminate the temporary protected status (TPS) designation of Angola, effective 3/29/03, based upon a recent review of conditions within that country. Former TPS beneficiaries will maintain the same status they held prior to TPS unless that status has since expired or been terminated.
