DOL on Labor Certifications for Employees Who Travel 100% of the Time

Dear Mr. Fleischer:

This is in response to your letter of May 16 inquiring about where an Application for Alien Labor Certification should be filed when the job opportunity requires 100% travel around the United States.

An application for labor certification for a job opportunity that involves 100% travel around the United States should be filed with the local employment service office having jurisdiction over the area in which the employer's main or headquarters office is located.

In Item 7 of Part A (address where the alien will work) of the Application of Alien Labor Certification, the employer should indicate that employment will involve 100% travel around the United States. A short statement should be included in support of the application explaining that the job opportunity involves 100% travel and indicating the locations where the employee will be traveling to monitor the employer's manufacturing requirements.
