Subject: Rules Governing Employment by Dependents of International Organization Employees

1. INS regulations permit dependents of employees of international organizations in the U.S. to work under certain circumstances. USG recently has been asked by two international organizations headquartered in Washington to modify these regulations. In particular, they are requesting elimination of offer of employment requirement which mandates that spouses and dependents wishing to work must submit an offer of employment from prospective employer indicating that person possesses qualifications to perform the job and outlining salary to be paid. In addition, position to be filled may not be on Labor Department’s “Schedule B” list (jobs for which there are sufficient U.S. workers who are able, willing, qualified and available for the occupations (primarily unskilled positions)).
2. In reviewing this request, Department wishes to study applicable regulations elsewhere and would appreciate it if posts could confirm that such dependents are entitled to work and secure from host government a copy of the rules or description of the practice governing the employment of dependents of international organizations locally. We would be particularly interested in knowing if there is a similar offer of employment requirement or if there are other restrictions which might apply. We also would like to know approximately how many personnel are assigned to international organizations in country and how long it takes for dependents to secure permission to work under appropriate regulations.
