Dear Ms. Merritt,
I am responding to your letter of March 15 concerning the effect of company mergers on I-140 petitions.
This is a very technical issue on which we are willing to follow INS’s lead. As the cases are scheduled for interview, I suggest that you provide the applicant, or mail to us, the successor-in-interest documentation for the petitioning company as well as any correspondence you've had with INS on the matter. I doubt that it will be an issue in any case in which the documentation shows that INS has reviewed the issue of successor-ininterest prior to approval of the I-140. In the other cases, if the necessary information is available at the time of the interview, the issue should not cause a delay.
