EOIR Issues Legal Opinion on EOIR’s Authority to Interpret the Term “Unaccompanied Alien Child”

EOIR’s Office of the General Counsel issued a legal opinion on EOIR’s authority to interpret “unaccompanied alien child” for applying certain provisions of the TVPRA. Opinion states that IJs are not bound by DHS determinations and may resolve any dispute about UAC status during removal proceedings.
