INS Advises on Original Signature on Form G-28

Dear Mr. Parsons:

Your recent inquiry concerning original signatures on Form G-28 Notices of Appearance has been referred to my office for reply. The letter seeks clarification as to whether the recently revised regulations 8 CFR 103.2(a)(3) and 8 CFR 292.4(a) permit the use of photocopies of an original Form G-28 that bears the required signatures.

The Office of Service Center Operations, which produced the current rule, has advised us that a Form G-28 Notice of Appearance bearing original signatures should be submitted with the original application or petition to which it pertains. Subsequent correspondence concerning the sam application or petition does not require an additional Form G-28; but the registered attorney or representative who opts to attach one anyway may, for that purpose, use a copy of the original G-28.
