2025 H-1B Proclamation: Employer Action Steps and Immigration Law Challenges

This program will provide a review of and conversation about the September 19, 2025, Presidential Proclamation which issued sweeping requirements including the accompaniment of a $100,000 supplemental payment. Facilitators and attendees will discuss practical tips on how to advise employers and foreign workers. Attendees will learn how the Proclamation interacts with existing immigration law, what exceptions may apply, and how to manage immediate travel and staffing risks. The discussion will also address anticipated rulemakings on prevailing wages and high-wage prioritization, adding long-term challenges for employers.

  • Anticipated rulemakings on prevailing wages and priority admissions for high-wage H-1Bs
  • Litigation Landscape: Statutory Authority: INA §212(f) and Presidential discretion limits, non-delegation / Separation of Powers and economic harm to employers and U.S. industries. Likelihood of temporary restraining orders (TROs) or preliminary injunctions. Timeline for judicial review and potential Supreme Court involvement.
