It has been one year since the Biden administration issued the “Circumvention of Lawful Pathways” rule, also known as Asylum Transit Ban. This broad rule bars most applicants from asylum if they entered through the U.S.-Mexico border on or after May 11, 2023. While limited exceptions do exist, the scope of this ban is extremely broad. Join us for this roundtable to learn more about when the rule does and does not apply, how to assert an exception to the rule, and the status of ongoing litigation challenging CLP. We will also provide a space for asylum practitioners to discuss how CLP is being interpreted in their jurisdictions and share strategies for arguing exceptions apply.
