AILA’s Verification & Documentation Liaison Committee, USCIS HQ (Benefits Policy) Liaison Committee, and DOL Liaison Committee are collaborating to provide members with an overview about how I-9, Fraud Detection & National Security (FDNS), and Labor Condition Application (LCA) investigations are conducted by ICE, USCIS, and DOL (respectively). Our panel of AILA leaders will address why an investigation is instigated, how the agency commences the investigation, employer and attorney interaction with investigators, timelines, and potential outcomes.
Featured Topics
- What can trigger an FDNS site visit?
- FDNS “on the ground”: scope of a visit, what an employer is required to provide during a visit, and potential outcomes
- Are I-9 investigations random or targeted?
- How long do I-9 investigations take and what are potential outcomes?
- Are DOL LCA investigations complaint driven?
- What are common DOL Wage & Hour Division enforcement issues and remedies?
