This roundtable will explore when habeas corpus is an appropriate tool to challenge immigration detention, agency inaction, or other custody-related issued. Our panelists will discuss the statutory and constitutional bases for habeas relief, the types of immigration cases where habeas is viable, jurisdictional limits, and strategic considerations in filing. Participants will gain practical insights into spotting habeas claims, evaluating timing and venue, and navigating the intersection of habeas with other remedies such as mandamus or APA actions.
This roundtable is presented by the AILA Benefits Litigation Committee.
AILA Video Roundtables are free interactive learning opportunities hosted by faculty selected for their expertise, with an emphasis on discussion and Q&A. This roundtable is not CLE eligible. The free recording will be available 7-10 business days following the live event.
