H.R. 5855 – Department of Homeland Security Appropriations
H.R. 5855, Appropriations bill for the Department of Homeland Security, was debated and passed in the House of Representatives over two days, June 6-7th, 2012. The House took up 20 immigration- or border security-related amendments and passed 13 of them. The House passed the bill by a vote of vote of 234-182, with most Republicans voting in favor of it and most Democrats voting against it.
- Amendment by Rep. Steve King (R-IA) prohibiting the implementation of the Morton 2011 memos on prosecutorial discretion
- Amendment by Rep. Sam Graves (R-MO) prohibiting implementation of the rule providing for a provisional unlawful presence waiver (family unity waiver)
- Amendment by Rep. Diane Black (R-TN) barring funding for the ICE Public Advocate position
- Amendment by Rep. Lou Barletta (R-PA) barring funding under the bill for so-called sanctuary cities
- Amendment by Rep. Chip Cravaack (R-MN) barring ICE from contravening INA Section 236(c), mandatory detention provision. Intended to prevent the release of and use of alternatives to detention for those who must be detained
- Amendment by Rep. Steve King prohibiting the use of funds to enforce the Limited English Proficiency Executive Order
- Amendment by Rep. John Sullivan (R-OK) barring the use of funds in the bill to terminate standing 287(g) agreements
- Amendment by Rep. Keith Ellison (D-MN) barring funds to any entity that violated the 5th and 14th Amendments to the United States Constitution, the 1964 Civil Rights act and two crime statutes. Rep. Ellison held up our "Immigration Enforcement Off Target" Report when he spoke on the floor in favor of the amendment
