Litigating A-File FOIA Requests & Getting Paid

Join AILA’s Fraud Victim Task Force for a discussion on how to obtain your clients’ A-files and other immigration records through FOIA litigation, while recovering reasonable attorneys’ fees and related expenses. This roundtable will cover tips and tricks for request design; things to consider for exhaustion, joinder, and venue; and litigation strategies for getting records quickly and collecting attorneys’ fees. Some familiarity with federal litigation (e.g., habeas, mandamus) is presumed.

AILA’s Fraud Victim Task Force was established in response to the deeply troubling and difficult situation that followed Alexandra Lozano’s permanent resignation of her law license in lieu of discipline and the subsequent closure of her firm. The Task Force seeks to coordinate efforts, identify emerging needs, develop additional resources and training, and facilitate information-sharing among members assisting individuals whose representation has been disrupted or who may have been affected by alleged misconduct.
