Advance Copy of DOL Final Rule on LCA Substitutions
Advance copy of final rule, scheduled for publication on 5/17, regarding prohibition of substitution of aliens on labor certification applications, limited validity period for labor certifications, and payment of costs of obtaining the certification.
On Friday, April 27, 2007, the Office of Management and Budget concluded its review of the DOL's proposed regulation to bar the substitution of aliens in labor certification proceedings, to bar the payment by the alien of the employer's attorney's fees and other labor certification costs, to limit the validity of a labor certification to 45 days, and to enhance penalties for violations of labor certification regulations. The DOL has included the regulation in its agenda of regulations in the final stages of review. The DOL has not published a final regulation and an effective date. However, it is expected soon.
