AILA President: Conservative Majority Strips Constitutional Protections from Migrants, Congress Must Act

Washington, DC - In response to the U.S. Supreme Court ruling Monday in Department of Homeland Security et al. v. D.V.D. et al., AILA President Jeff Joseph stated:
"The U.S. Supreme Court has permitted the Trump Administration to shirk its constitutional obligation to provide due process and notice to noncitizens facing deportation to countries with which they have no prior connection, essentially a green light to secret deportations, including to countries considered dangerous. I stand with Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson in their forceful dissent, rightly condemning the ruling as a 'gross abuse' of the Court’s equitable discretion.
"This decision is not only deeply troubling in itself, it is part of a broader pattern of the Administration denying basic legal protections to vulnerable individuals. By enabling the executive branch to bypass essential safeguards, and engage in cruel and chaotic practices, the Court is undermining the very principles it is meant to defend.
"As judicial checks continue to erode, it is imperative that Congress act and assert its constitutional role. Protecting due process is not optional, it is the backbone of our democracy."
