1. During the recent VO/AILA meeting, AILA reported that several posts are declining to send packet 4 to IV beneficiaries with U.S. addresses. Posts cited instructions in Ref C ALDAC, Para 5, which told posts not to send Packet 4 nor Schedule appointments for beneficiaries in the United States. But rather to send them a letter explaining the option to adjust status under INA 245I.
2. These instructions have been superseded by NVC's practice, effective January 11, 1995, of sending beneficiaries with U.S. addresses a tear-off sheet, asking them if they prefer adjustment of status or consular processing. NVC now sends to posts the files of only those beneficiaries who notify NVC of their intent to apply overseas (in addition to applicants resident overseas). The tear-off sheet indicating the beneficiary's choice is included in his/her file. Posts can therefore assume that every file they received, including those with U.S. addresses, is for an applicant who intends to apply for an immigrant visa. These applicants should routinely be sent packet 4 and scheduled for an interview.
3. The Visa Office regrets any confusion this change in procedures has caused.
