SUBJECT: A New Form - DS-3035, J-1 Visa Waiver Review Application

1. The Department announces the introduction of a new form, J-1 Visa Waiver Review Application (DS-3035). Effective immediately, applicants will use this form to apply for a waiver of the two-year residency requirement prescribed by Section 212(e) of the Immigration and Nationality Act. The Waiver Review Division (CA/VO/L/W) will then use the data captured by this form to initiate the process of recommending to the Immigration and Naturalization Service whether it should grant the waiver. The DS-3035 is an updated version of a form inherited from the former United States Information Agency (USIA) when USIA merged with the Department.

2. The DS-3035 is now available on the A/RPS/DIR Intranet site (http://10.4.64.84/). This site is the official repository for all Department forms. The form is also available to the general public on the Department's Internet site (www.state.gov).

3. Given the nature of the form, we do not anticipate that posts will have a need to print large quantities of the DS-3035. If necessary, posts may print the DS-3035 locally, using the version on the A/RPS/DIR Intranet site as a camera copy. Posts should not translate this form into any foreign language. Posts are also reminded that the DS-3035 is subject to the Paperwork Reduction Act of 1995 (PRA), which is administered by the Office of Management and Budget (OMB). Pursuant to the PRA, OMB gives approval for agencies to use "information collections" like the DS-3035 for a maximum of three years at a time. Posts may not/not make any changes to the text of the DS-3035, nor may they modify the layout.
