Today, the Department of Homeland Security published a final rule in the Federal Register
0:00:09.969–0:00:15.520
that amends the regulations governing petitions filed under the H-1B visa lottery.
0:00:15.520–0:00:21.340
The final rule makes two major changes: it adds an electronic registration requirement
0:00:21.340–0:00:25.820
for petitioners seeking to file H-1B cap-subject petitions,
0:00:25.820–0:00:31.840
and it reverses the order by which USCIS will select petitions under the H-1B cap
0:00:31.840–0:00:37.180
and the advanced degree exemption. Under the final rule, USCIS will count
0:00:37.180–0:00:42.320
all applicants towards the regular cap first, then select applicants towards
0:00:42.320–0:00:45.200
the advanced degree exemption second.
0:00:45.200–0:00:50.460
The final rule will go into effect on April 1, though the Department of Homeland Security
0:00:50.460–0:00:56.240
will suspend the electronic registration requirement for this year’s H-1B cap.
0:00:56.280–0:01:02.100
This means that H-1B cap-subject petitions filed as part of the FY2020
0:01:02.100–0:01:08.220
H-1B cap will need to be filed using the same process as in prior years, with petitioners
0:01:08.220–0:01:12.520
submitting a complete H-1B petition to USCIS,
0:01:12.520–0:01:20.720
together with filing fees, in order to be eligible for selection in the FY2020 visa lottery.
0:01:25.180–0:01:29.120
AILA welcomes the suspension of the electronic registration requirement
0:01:29.120–0:01:34.680
for this year’s H-1B cap filing season in order to allow USCIS sufficient time
0:01:34.680–0:01:39.900
to complete the necessary user testing and to ensure the system and process are fully
0:01:39.909–0:01:44.889
functional before they are implemented. AILA raised this concern during the notice
0:01:44.889–0:01:48.721
and comment period, and we would like to thank the hundreds of AILA members who
0:01:48.721–0:01:54.499
submitted a comment to USCIS as part of AILA’s H-1B comment campaign.
0:01:54.499–0:02:01.770
Thanks to you, USCIS heard our concerns. Per the final regulation, DHS anticipates that
0:02:01.770–0:02:10.040
the registration requirement will be implemented next year, starting with the FY2021 H-1B cap.
0:02:10.040–0:02:14.350
USCIS has indicated that it will engage in stakeholder outreach and provide training
0:02:14.350–0:02:21.080
to the public on the registration system in advance of its implementation, so stay tuned.
0:02:25.240–0:02:30.560
The second major change, the reversal of the order by which USCIS selects petitions
0:02:30.560–0:02:35.800
under the H-1B cap and the advanced degree exemption, will take place this year.
0:02:35.800–0:02:41.060
USCIS anticipates that this change will result in an increase of up to 16%
0:02:41.060–0:02:48.090
or 5,340 workiers in the number of selected petitions for H-1B beneficiaries
0:02:48.090–0:02:53.860
with a master’s degree or higher from a U.S. institution of higher education.
0:02:53.860–0:02:58.700
