AILA Requests Clarification from USCIS on Implementation of Temporary Injunction Issued in Behring v. Mayorkas

AILA submitted a letter to USCIS requesting clarification with respect to the revised USCIS policies required to implement the preliminary injunction issued on June 24, 2022, in Behring Regional Center LLC v. Mayorkas, a lawsuit challenging USCIS’s implementation of EB-5 Reform and Integrity Act of 2022.

On July 28, 2022, USCIS Director Ur M. Jaddou sent a response to AILA, which reads, in part:

United States Citizenship and Immigration Services (USCIS) now considers previously designated regional centers ‘designated’ under the new legislation in compliance with the preliminary injunction. In light of the June 24, 2022, decision, USCIS has begun updating our website and will continue releasing additional guidance for regional centers as it becomes available.
