DHS and DOL Temporary Rule Authorizing 20,000 Additional H-2B Visas for First Half of FY2022
DHS and DOL temporary rule authorizing the issuance of up to 20,000 additional H-2B visas during FY2022 for positions with start dates on or before 3/31/22. Of the 20,000 visas, 13,500 are reserved for returning workers regardless of country of nationality, and 6,500 are reserved for nationals of Haiti, Honduras, Guatemala, and El Salvador. The rule also provides temporary portability flexibility by allowing H-2B workers who are already in the United States to begin work immediately after an H-2B petition is received by USCIS, and before it is approved. Comments will be accepted on the new Form ETA-9142B-CAA-5 associated with the rule until 3/29/22. (87 FR 4722, 1/28/22)
