ICE Updates Policy on Accessing HHS Data
ICE Policy Memorandum 11066.2, titled Use of HHS Information and Rescission of ICE Policy Memorandum 11066.1, updates ICE policy on accessing health-related federal data. It rescinds the prior 11066.1 policy (which had clarified existing practices related to certain health care information). Under 11066.2, ICE reaffirms its authority to request, receive, and use information held by the Department of Health and Human Services (HHS)—including data from the Centers for Medicare & Medicaid Services (CMS)—for immigration enforcement purposes consistent with federal law. The policy reflects that certain health-related information (such as immigration status, contact, and location data collected through programs like Medicaid) can be used to support ICE’s enforcement mission.
