Re: Naturalization Eligibility Date for SAW Workers

Dear Mr. Parsons:

The district received conformation that our interpretation of 8 CFR 210.5 was in error as relates to determining the date of adjustment to permanent residence alien status for aliens who adjusted under section 210 of the Act.

We have already reopened those N -400 applications that had been rejected based upon there not having the requisite five years as a permanent resident alien. These newly reopened cases will be set for interviews the first week of June of 1996.

Those applicants who were approved under Group B will be given an adjustment date of 12/01/90 and those applicants approved under Group A will be given an adjustment date of 12/01/89.
