On January 14, 2020, AILA sent a letter to USCIS requesting a change to the USCIS Policy Manual: Volume 7, Part A, Ch. 8, Section D, entitled “Portability Provisions” that suggests that all physicians with approved NIW petitions are subject to the two-year home residence requirement of INA §212(e).
