AILA and partners submitted a brief in response to BIA’s amicus invitation on Niz-Chavez v. Garland, arguing that the requirements in INA §239(a)(1) are, at a minimum, mandatory claim processing rules that must be enforced whenever a respondent timely objects to a non-compliant NTA and termination is the proper remedy for the violations.
