Download the DocumentDHS and DOL document withdrawing, due to the receipt of significant adverse comment, the direct final rule published at 86 FR 1 on 1/4/21 that would have extended DOL’s recently established system of discretionary Secretary of Labor review to H-2B labor certification cases pending before or decided by BALCA. The effective date of the direct final rule was 2/3/21. The document does not withdraw the companion proposed rule, published at 86 FR 29 on 1/4/21, and thus a procedural framework to respond to the comments received and finalize the rule at a later date remains in place.
