AILA and the Council File Joint Public Comment in Opposition to DHS Proposed Rule on Employment Authorization for Asylum Seekers
AILA and the American Immigration Council submitted a joint comment urging DHS to withdraw its proposed rule which would stop acceptance of asylum seekers’ EAD applications during periods when average processing time for affirmative asylum exceeds 180 days, extend the waiting period to apply for employment authorization to 365 days, change EAD application processing time requirements, and add eligibility requirements.
AILA and the Council argue that the proposed rule offers no rational justification for drastic limits on EADs, relies on vague and unclear terms, and fails to consider how the proposal interacts with other recent policies.
