AILA Submits Amicus Brief Urging CA9 Petition Rehearing and Rehearing En Banc in Rivera Vega

AILA submitted an amicus brief in support of the petitioner’s request for panel rehearing and rehearing en banc of Rivera Vega v. Garland, arguing that the panel’s summary Patel ruling is incorrect and would thrust the Ninth Circuit into a circuit split and contravenes Ninth Circuit law. Additionally, the amicus argues that the panel’s erroneous holding that 8 U.S.C. 1182(a)(9)(C)(i)(II) applies retroactively overturns a quarter century of settled, nationwide agency interpretation, and will have devastating effects on noncitizens in the Ninth Circuit.
