Latest on First PERM Appeal to BALCA
Counsel for the Certifying Officer requested leave to file a reply brief. Both the employer and Amici Curiae opposed the request because it would delay resolution of the matter and because the Board’s original briefing notice did not permit reply briefs. BALCA ruled that because the case will result in the first Board decision under the new PERM regulations and it presents an issue that is likely to impact on the resolution of many pending PERM appeals, it granted a short period for the filing of the reply brief. The Employer and Amici were given an opportunity to file responses to DOL’s Reply Brief.
