USCIS Reminds Employers to Ensure Employees Choose Correct Attestation on Form I-9
September 17, 2020
USCIS issued a correction noting that employers are not held liable for erroneous attestations an employee makes in Section 1 of Form I-9. Rather, employers must ensure that employees check only one box to complete Section 1 and are provided with the entire Form I-9 including instructions for completing the form.

USCIS reminds employers to review the Employee Information and Attestation area in Section 1 of Form I-9 for two common mistakes employees make: falsely attesting to being a U.S. citizen, and choosing “noncitizen national of the United States.” Employers can be held liable for these errors.
