D.C. Circuit Allows Expansion of Expedited Removal
July 17, 2026: The D.C. Circuit granted the government's renewed motion in Make the Road New York v. Mullin seeking to have the expanded expedited removal policy take effect immediately. The government filed this motion following the 6/23/26 decision below because the policy remained blocked as the mandate in the appeal has not been issued. The expansion designation is now unblocked and in effect. (Make the Road New York v. Mullin, 7/17/16)

June 23, 2026: In a 2-1 vote, a D.C. Circuit panel vacated a district court’s stay of the Trump Administration’s 2025 expansion of expedited removal. The ruling allows DHS to apply expedited removal nationwide, regardless of distance from the border. (Make the Road New York v. Mullin, 6/23/26)
