DHS Determination Waiving Some Laws to Construct Barriers near Border in New Mexico

DHS Secretary Kristi Noem issued a notice of determination, effective 6/3/25, that it is necessary to waive certain laws, regulations, and other legal requirements to ensure the expeditious construction of barriers and roads in the vicinity of the international land border in the state of New Mexico. The notice states that the determination is in response to high numbers of border crossings without inspection in the El Paso Sector. This determination follows E.O. 14165, section 3.
