DHS to Publish IFR with Penalty for Unpaid Annual Asylum Fees and Other H.R. 1 Requirements

DHS announced an IFR implementing H.R. 1 fees and requirements, effective 5/29/26. The rule states that USCIS will reject asylum applications if the Annual Asylum Fee is not paid within 30 days of notification. It also establishes a minimum $24 filing fee for Form I-102, limits the validity of employment authorization issued under TPS to the shorter of a year or the remainder of the TPS period, and states that USCIS will keep the asylum filing fee for forms rejected as improperly filed.

An advance copy of the rule, to be published in the Federal Register on 4/29/26, is available. Comments will be due 6/29/26.
