A 2/11/08 DOJ Office of Legal Counsel opinion concludes that the statute authorizing the H-1B program does not waive the federal Government’s sovereign immunity, therefore the award of back wages to eleven alien physicians employed by VA hospitals who were not paid the the prevailing wage is barred.
