DOL Notice of Proposed Rulemaking on Protections for H-2A Workers
DOL notice of proposed rulemaking (NPRM) to amend the regulations governing the certification of H-2A workers and the enforcement of the contractual obligations applicable to employers of H-2A workers. DOL states that the proposed revisions “focus on strengthening protections for temporary agricultural workers and enhancing the Department’s capabilities to monitor program compliance and take necessary enforcement actions against program violators.” Comments are due 11/14/23. On September 15, 2023, the Department of Labor (DOL) published in the Federal Register a Notice of Proposed Rulemaking (NPRM) that would enhance worker protections in the H-2A program. On October 26, 2023, in response to several requests, DOL published a letter on regulations.gov declining to extend the 60-day comment period for the NPRM that will expire on November 14, 2023.
