1. As the political situation in Zaire continues to deteriorate, the Department provides the following guidance regarding nonimmigrant visa applications from Zairian Nationals and other third country national residents of Zaire.
2. Posts should note that government officials or others associated with the Mobutu regime who are impeding democratic reforms are ineligible for visas under the 1993 INA 212(F) Presidential Proclamation on Zaire. This includes all Zairian diplomats stationed abroad. A request for advisory opinion must be submitted in all cases in which 212(F) may apply. Consular officers may wish to review Reftel B, an ALDAC describing special processing requirements for selected countries, and the Entry for Zaire in 9 FAM Appendix C.
3. We also note that under the present circumstances few Zairian visa applicants, whether or not subject to the 212(F) proclamation, are likely to qualify under INA 214(B) (in visa categories in which that applies), Reftel A is any ALDAC which describes circumstances that would negatively impact on a third-country national’s eligibility for a nonimmigrant visa, such as civil unrest in the person’s home country. All NIV applications from persons claiming ties to a residence in Zaire, including those previously issued an NIV should be carefully reviewed.
