EOIR Issues Memo on IJ Decisions Imbedded in the Transcripts

Obtained via FOIA by Hoppock Law Firm, EOIR released a memo from Lori L. Scialabba to BIA Board members stating that pursuant to Matter of A-P-, beginning 3/4/04, the Board should consistently remand all decisions from IJs in non-detained cases where the IJ's oral decision is embedded in the transcript itself and there is no separate transcribed oral decision in the record. Detained cases of this type should be handled on a case-by-case basis. Special thanks to Matthew Hoppock.
