ICE Criminal Justice Stakeholder Forms Program

In August 2013, the Office of Enforcement and Removal Operations (ERO) Custody Programs and Community Outreach (CPCO) initiated a Criminal Justice Stakeholder Forms pilot. We began with a limited roll-out to the American Probation and Parole Association (APPA) but would now like to expand beyond APPA stakeholders to include criminal defense counsel, prosecutors, criminal investigators, court officials, and criminal justice agencies other than a court or prosecutor’s office and request the working group’s assistance in spreading the word about this pilot.
For an overview, ICE periodically takes enforcement action against aliens who also have obligations within the criminal justice system. These actions may conflict with state or local criminal justice proceedings, which may create a need for additional information sharing with state and local authorities. For example, an alien may miss a court hearing and forfeit bond money or be absent from a meeting with a parole officer and be subject to penalties as a result. ICE developed these Criminal Justice Stakeholder Forms to give criminal justice professionals access to relevant and reliable information from ICE when working with aliens in these circumstances. The information provided through this process can be used to verify that the alien’s absence from court or other failure to meet a criminal justice obligation was due to ICE enforcement, detention, or removal.
Please find attached the Criminal Justice Stakeholder Forms Fact Sheet and the criminal justice stakeholder Request Form. Please circulate them to the working group. While working group members are not necessarily the intended stakeholders for these forms, perhaps you and your colleagues have contacts among criminal defense attorneys or other criminal justice stakeholders who would benefit from awareness of this pilot.
