ICE Policy 10039.3: Consideration of U.S. Military Service During Civil Immigration Enforcement Actions
This memo provides ICE personnel guidance on considering U.S. military service during civil immigration enforcement actions. It is effective 4/10/25 and supersedes ICE Directive 10039.2. The memo states that U.S. military service alone will not automatically exempt noncitizens from immigration enforcement actions. Considerations include whether the noncitizen is in active duty, their possible eligibility for naturalization based on military service, and other factors.
