INS Advises Consultations for Theatrical Employers
Attached for your information is a letter form Bryan Unger, the International Representative of the International Alliance of Theatrical Stage Employees (IATSE). Mr. Unger states in his letter that his union represents still photographers, make-up artists, and hairstyles. As a result, Service officers involved in the adjudication of petitions for O nonimmigrants in these fields should accept IATSE's consultations as evidence that the consultation requirements of section 214(c)(6)(A)(i) have been met.

The following is the February 25, 1994 letter from G. Bryan Unger, International Representative (IATSE) to John Brown, Senior Examiner (INS):
Dear John:
I understand there has been some question regarding the jurisdiction of the IATSE as it relates to O and P consultations.
In the instant case, the IATSE represents and has been consulting on still photographers, makeup artists and hairstylists. There is a considerable amount of cross over in the visual arts, and the individuals may or may not be employed in crafts or occupations represented by the IATSE. To date, I am aware of no prior problems resulting from IATSE consultations.
Secondarily, the IATSE has and will continue to represent and consult on technicians and craftspersons involved in audio visual production such as filmed or videotaped entertainment, live performances of a musical or dramatic nature, and theme park entertainment.
If you would like a more comprehensive breakdown of our members' occupations, I would be willing to provide one. The general definitions above should suffice for now.
