SUBJECT: Extension of TPS for Bosnia and Somalia; Reregistration Filing; Late Initial Registration
1. Re Bosnia: The Attorney General has determined that TPS for Bosnia will be extended until 10 August 1996. Starting immediately, Officers should grant Bosnian TPS extensions valid until 10 August 1996.
Re Somalia: The Attorney General has determined that TPS for Somalia will be extended until 17 September 1996. Starting on 19 August 1995, Officers should accept applications and grant Somalian TPS extension valid until 17 September 1996.
Separate public notices for these countries will be published in the Federal Register on 31 July 1995.
2. In addition to the 30-day reregistration periods specified by the Federal Register notices, late reregistration continues to be liberally excusable.
3. Current Bosnian and Somalian TPS registrants who desire an extension must file an application for Temporary Protected Status, Form I-821, without fee, together with an application for employment authorization, Form I-765. A fee of $70.00 must accompany Form I-765, unless a properly documented fee waiver is submitted or the applicant does request employment authorization.
4. In EAD processing, key in the new TPS expiration date of "08/10/96" for Bosnia and the new TPS expiration date of "09/17/96" for Somalia. In order to reach these expiration dates, it is necessary that the EAD employment start date is not earlier than "08/11/95" for Bosina and not earlier than "09/18/95" for Somalia. The recently distributed EADs standalone software release V4.7 must be installed to allow adjudication and EAD card issuance for these TPS extensions.
5. All TPS applicants must be given notice by a properly completed From M-340 for initial registration approvals or by a Form M-344 for initial registration denials or subsequent withdrawals.
6. Because the Attorney General has ordered extension of the original TPS designations but not new designations, all Bosnian Registrants must have been "continuously physically present" in the United States since 10 August 1992. All Somalian registrants must have been "continuously physically present" in the United States since 16 September 1991. Refer to 8 CFR 240.17 for additional information on reregistration.
7. For applicants meeting the presence requirement specified in Part 6 above, initial registration after the original one-year registration period is allowed in limited circumstances. The requirements for such "late initial registration" during a period of TPS extension are set by 8 CFR 240.2 (f)(2).
