INS Issues New "Top 100 H-1B Users" List

During the first 5 months of Fiscal Year 2000, the Immigration and Naturalization Service (INS) approved 81,262 petitions submitted by U.S. employers on behalf of H-1B nonimmigrant workers. This report lists the companies with the most workers authorized to begin employment during that period: October 1, 1999 to February 29, 2000.[1] The characteristics of these workers are described in the INS report titled Characteristics of Specialty Occupation Workers (H-1B): October 1999 to February 2000. The workers include both those subject-to and exempt-from the annual cap on H-1B petitions.[2]

The following table lists the 102 companies with more than 60 INS-approved petitions. These companies account for 13,940 petitions, or slightly more than 17 percent of the total petitions approved during the first 5 months of Fiscal Year 2000.

The company list is summarized by the name provided on the petition and entered into INS’ database. Because H-1B petitioner names are sometimes recorded in the database for a company differently, the counts in the table should be interpreted as representing a minimum number for a given company. For example, the same company may appear in one petition with “corporation” and without “corporation” in its name on a second petition, or a name may have been listed or typed incorrectly. Company names were edited to correct for obvious errors and to apply common abbreviations to facilitate matching; however, some companies may still be listed more than once. In addition, related companies are listed separately.

[1] In certain cases, more than one U.S. employer submitted a petition on behalf of an individual H-1B worker; therefore, the number of approved petitions exceeds the number of individual H-1B workers.

[2] Section 214(g) of the Immigration and Nationality Act establishes a numerical limit, or “cap” on the number of aliens issued H-1B visas or otherwise provided H-1B status. Under law the cap is set at 65,000, but has been raised temporarily with passage of the American Competitiveness and Workforce Improvement Act of 1998. In fiscal years 1999 and 2000, the cap is 115,000 and in Fiscal Year 2001 the cap is 107,500. To maintain the annual H-1B cap, INS records only the approvals of petitions submitted for “new” employment on behalf of alien workers who are not already in the United States in H-1B status. Other H-1B petition approvals are not recorded against the Fiscal Year 2000 cap of 115,000. Of the 81,262 workers named on the approved petitions as of the end of February, a total of 51,574 were subject to the cap, and the remaining 29,688 workers were exempt from the cap. The workers exempt from the cap were previously approved for H-1B employment.
